Detailed Terms and Conditions

1. Eligibility

The contest is open to any person who has traveled on a mobile safari with Bush Ways.

2. Agreement to rules

By participating, the Contestant agrees to be fully unconditionally bound by these Terms and Conditions.

3. Campaign period

Submissions will be accepted from 20 February 2017 to 31 January 2018.

4. How to Enter

The contest is automatically entered by submitting a video clip to marketing@bushways.com via Dropbox or similar.
Multiple submissions are accepted.

5. Prize

The winner of the Contest will receive: One Free Bush Ways “Fish Eagle Safari” between 1st April 2018 and 31 March 2019 for one person.
No cash or other prize substitution shall be permitted except at Bush Ways’ discretion.
The prize is transferable to a person of your choice.
The prize cannot be exchanged for cash from Bush Ways or another individual.
All other expenses related to the prize are to be borne by the traveler.

6. Rights granted by the contestants

By submitting their video(s), the Contestant understands and agrees that Bush Ways, anyone acting on behalf of Bush Ways, and Bush Ways’ licensees, successors, and assigns, shall have the right, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, the video, for news, publicity, information, trade, advertising, public relations, and promotional purposes, without any further compensation, notice, review, or consent.

The Contestant represents and warrants that their video is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If the content of their entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, they shall, at their sole expense, defend or settle against such claims. They shall indemnify, defend, and hold harmless Bush Ways from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Bush Ways may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

7. Limitation of Liability

By entering, the Contestant agrees to release and hold harmless Bush Ways and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, in relation to the Contest.

8. Disputes

This Contest is governed by the laws of Botswana. As a condition of participating in this Contest, the contestant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Botswana.
